NYC Public Advocate's Statement on the Attorney General's Decision Not to Pursue Charges in The Killing of Win Rozario

December 4th, 2025

"Win Rozario’s family called for help and was met with force. We all saw on video that he was shot amid a mental health episode despite the pleas of his mother and the lack of any real justification. If we are at all serious about safety, there needs to be accountability for officers in this particular case and systemic change to mental health response moving forward.

"If this incident doesn’t rise to the level of potential conviction on any criminal charges, that in itself is an indictment of the standards for any accountability in a police shooting – that in itself is an injustice. There is moral and governing value in pursuing this case, in showing that Win Rozario’s life had value and his death has consequences. This decision is part of a historic system which denies that."
